Che cos'è un codice NC e dove lo trovo?
Il codice NC (Nomenclatura combinata) è il codice doganale a 8 cifre di un prodotto, lo stesso che usi nella dichiarazione doganale e nella fattura di esportazione. Lo trovi nella tua documentazione doganale, nel sistema TARIC o presso la tua agenzia doganale. Lo inserisci in Restrikt per verificare lo stato sanzionatorio della voce.
Che cosa significa l'assenza di corrispondenze per il codice NC nel risultato?
Nessuna corrispondenza significa solo che il codice NC indicato non è stato trovato nella nostra banca dati dei regimi, non che il commercio sia consentito. Verifica un livello superiore del codice NC, l'altro regime e, separatamente, l'elenco delle persone ed entità sanzionate. Il testo vincolante è il regolamento UE, non il risultato dello strumento.
In che cosa differisce il regime 833/2014 (Russia) dal 765/2006 (Bielorussia)?
Sono due atti giuridici UE distinti, ciascuno con i propri allegati relativi alle merci. Il regolamento 833/2014 riguarda la Russia e il regolamento 765/2006 la Bielorussia, e lo stesso codice NC può essere vietato in un regime e assente nell'altro. Per questo verifichi la voce separatamente per ciascuna destinazione, e Restrikt mostra il risultato con la base giuridica propria del regime considerato.
Quali regimi copre lo strumento?
Quattro regimi UE sulle merci: Russia (regolamento 833/2014), Bielorussia (regolamento 765/2006), Corea del Nord (regolamento 2017/1509) e Iran (regolamento 267/2012). Che cos'è la clausola No Russia (art. 12g) e chi riguarda?
The No Russia clause is a requirement under art. 12g of Regulation 833/2014 to contractually prohibit the re-export of certain sensitive goods to Russia in sales to third countries. It applies to EU exporters selling, among others, dual-use goods and items from selected annexes. In practice you place the relevant contractual clause in the contract and on the invoice, and its absence may be treated as a failure of due diligence.
Che cosa significa un'esenzione o una deroga ai sensi dell'art. 3k?
Article 3k of Regulation 833/2014 bans the export of a broad list of industrial goods set out in Annex XXIII. At the same time it provides exemptions and derogations, that is situations where trade remains permitted, for example performing contracts concluded before the ban took effect. Exemptions are attached to the article, not to the individual CN code, so Restrikt shows the mechanism of the article covering your code and points to the relevant paragraph on EUR-Lex. Whether it applies to a specific transaction is confirmed by the customs authority or a law firm.
Il CBAM è una forma di sanzione?
No. Il CBAM, il meccanismo di adeguamento del carbonio alle frontiere, è un obbligo di comunicazione e di pagamento legato all'importazione di merci ad alta intensità di carbonio come acciaio, alluminio, cemento o fertilizzanti. Le sanzioni sono divieti e restrizioni commerciali derivanti dai regolamenti 833/2014 e 765/2006. Sono due regimi giuridici diversi, quindi lo stesso prodotto può essere soggetto al CBAM e allo stesso tempo non essere coperto dalle sanzioni, o viceversa.
Come documento la dovuta diligenza nell'esportazione?
Conserva una registrazione della verifica per ogni voce: codice NC, stato sanzionatorio, regime, allegato e articolo, data della versione del regolamento e link a EUR-Lex. Aggiungi lo screening della controparte rispetto agli elenchi delle sanzioni e, dove l'art. 12g lo richiede, la clausola No Russia nel contratto. Restrikt genera un report PDF con questi dati da allegare al fascicolo dell'operazione come prova della dovuta diligenza in caso di controllo doganale.

In che cosa differisce dallo screening di persone ed entità?
Restrikt verifica le merci, ossia se un determinato codice NC è soggetto a una restrizione all'importazione o all'esportazione. Lo screening sanzionatorio è un processo separato che verifica la controparte, ossia una persona o un'entità, rispetto agli elenchi delle sanzioni. Servono entrambi i passaggi, lo strumento non sostituisce lo screening delle controparti.
